Car Accidents result in medical expenses, lost time from work, pain and suffering, vehicle damage, and other damages.

What car accident settlements should include:

Compensation for medical expenses including office visits and therapy charges for chiropractors, medical doctors, physical therapists, and surgeons. Medications both over the counter and prescription are also compensated for.
Compensation for lost time from work. You will need a signed letter or form from your employer and/or check stubs that prove that you lost income as a result of your injury.
Compensation for pain and suffering. "Pain and suffering" refers to the time you were unable to enjoy your normal life due to pain from the car accident. It is also intended for the period of time you endured pain while still working or performing daily household activities.
Compensation for your vehicle damage.
Compensation for any other incidental expenses you incur as a direct result of the collision.

The ABC's of a car accident settlement:

A. Immediately find a doctor specializing in car accident injury treatment. If you go to a doctor specializing in auto accident injuries, this treatment will not cost you anything up front out of your pocket. Your treatment will be paid by: your health insurance, your automobile accident medical policy, any other accident insurance policy you may have. If you have no insurance coverage then the doctor may extend treatment to you on a "lien" basis. This is where you sign an agreement promising to pay the doctor at the end of the case out of the settlement you reach with them. Always make sure your doctor accepts liens, not all do.

B. Once treatment has concluded and you have been released by your doctor. Assemble all of your medical bills and get reports from all of your doctors. It is best to have one large report from a car accident injury specialist that encompasses all the reports from the other doctors and therapists. You will submit this final report to the responsible insurance company along with all documentation of medical expenses, lost wages, unpaid vehicular damage, etc with a cover or demand letter. This letter will spell out exactly how much you are demanding to settle the case for.

C. Once the insurance company has received your demand and documentation they will begin the negotiation process with you. Do not be alarmed. The insurance company tactic is always to try top intimidate you and make you feel bad for asking for monetary damaged for your injuries. Keep in mind that you suffered injury and monetary losses as the direct consequence of their insured's negligence. Accidents are rarely "accidental," rather they are negligence on the part of the other driver who was talking on the phone, looking at the radio, looking ahead in traffic instead of directly in front of them, etc. You deserve compensation for your injuries, time and aggravation. It is likely you will get a low first offer and then need to rebut their assertions to finally arrive at a reasonable amount to settle at. This is where a true car accident specialist can help. Second, your medical reports will tell you attorney and the insurance company how badly you are injured, if you need future medical treatment, if you are permanently disabled, etc. And third, the value of your case is based upon the value of your medical treatment. To a reasonable point, larger medical bills means larger total settlements. The caveat being reasonable medical expenses. You can't have a "hang nail" and expect to rack up $6,000 in bills and expect to get them paid.
